Ape Ryder Australia – Terms & Conditions
1. Introduction
These Terms and Conditions ("Terms") govern the purchase and use of e-bikes ("EPACs") supplied by Ape Ryder Australia ("we," "our," or "us"). By purchasing or using an e-bike from Ape Ryder, you ("you," "the customer," or "the rider") agree to be bound by these Terms and all applicable laws in Australia.
2. Compliance with Legislation
All e-bike models sold by Ape Ryder Australia are designed to comply with NSW Electrically Power-Assisted Cycles (EPAC) legislation at the point of sale.
Key compliance points:

Maximum continuous rated motor power: 250watts (All States except NSW) & 500 watts (NSW)

Maximum load capacity: 150 kg

Speed limitation: 25 km/h or less for public road use

Progressive power control: Motor assistance decreases as speed increases and cuts out at 25 km/h or when pedaling stops above 6 km/h, in line with EPAC requirements.

Throttle usage:

Throttles are intended only for use on private property.

Throttles must be isolated when riding on public roads.

State variations: For states outside NSW where maximum continuous rated power is capped at 250W, we recommend reducing the maximum speed to 20 km/h to ensure compliance.
In our opinion, all Ape Ryder models are compliant with EPAC legislation when sold and are safe for public use. However, it is your responsibility to ensure the e-bike settings meet local state or territory laws.
3. Rider Responsibilities

Riders must wear an Australian Standards-approved helmet at all times.

You must comply with all local road rules and cycling regulations.

You must not operate an e-bike under the influence of alcohol, drugs, or medication that impairs your ability.

Before using your Ape Ryder e-bike, you must check and adjust settings to ensure compliance with local legislation.
4. Purchases

All purchases are subject to availability and confirmation of price at checkout.

Prices are in AUD (Australian Dollars) and include GST where applicable.

Ape Ryder provides warranties in accordance with the Australian Consumer Law (ACL).
5. Warranty & Consumer Rights

Our e-bikes are covered by the consumer guarantees under the ACL, which cannot be excluded.

If your Ape Ryder is faulty, you are entitled to a repair, replacement, or refund in accordance with the ACL.

Warranty does not cover damage caused by:

Misuse, abuse, or neglect.

Modifications outside of compliance settings.
-
Use of throttles on public roads (where prohibited).
6. Liability & Risk

Riding an e-bike carries inherent risks. By purchasing or using an Ape Ryder e-bike, you acknowledge these risks.

Ape Ryder is not liable for:

Injuries, accidents, or death arising from use of the e-bike.

Damage to personal property.
-
Losses resulting from failure to comply with laws or misuse of the bike.

Nothing in these Terms excludes your statutory rights under the ACL.
7. Cancellations & Refunds

Refunds and exchanges are handled in line with the ACL.

Orders may be cancelled prior to shipping for a full refund.
8. Privacy

We collect and manage personal information in accordance with the Privacy Act 1988 and our Privacy Policy.
9. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
